Therearemanyoccasionswhenthehelprenderedbythevillagecommunitiestothelordmaybeperceiveddirectly。Ineedhardlymentionthefactthatthesurveys,whichformthechiefmaterialofourstudy,werecompiledinsubstancebysworninquests,themembersofwhichwereconsideredasthechiefrepresentativesofthecommunity,andhadtogivewitnesstoitslore。Thegreatmonasticandexchequersurveysdonotgiveanyinsightintothemodeofselectionofthejurors:itmayheguessedwithsomeprobabilitythattheywereappointedforthespecialpurpose,andchosenbythewholecourtofthemanor。Insomecasestheordinaryjurorsofthecourt,orchiefpledges,mayhavebeencalledupontoserveontheinquest。Thereisanotherpointwhichitisimpossibletodecidequiteconclusively,namely,whetherquestionsaboutwhichtherewassomedoubtorthejurorsdisagreedwerereferredtothewholebodyofthecourt。But,althoughwedonothearofsuchinstancesinourgreatsurveys,itissurelyanimportant。indicationthattheextantcourt-rollsconstantlyspeakofthewholecourtdecidingquestionswhentheverdictofordinaryjurorsseemedinsufficient。Andsuchreservedcaseswerebynomeansrestrictedtopointsoflaw;veryoftentheyconcernedfactsofthesamenatureasthoseenrolledinthesurveys。(2*)
